These Terms of Use (“Terms”) constitute a legally binding agreement between you (“you,” “user”) and Bunker Bros Entertainment LLC (“Bunker Bros,” “we,” “us,” or “our”) governing your access to and use of the Bunker Bros mobile application, website, and related services (collectively, the “Service”).

By accessing or using the Service, you agree to be bound by these Terms.

Eligibility

• You must be at least 18 years old.
• By using the Service, you represent and warrant that:
  • You have the legal capacity to enter into this agreement
  • You will comply with all applicable laws and regulations
• We reserve the right to suspend or terminate accounts suspected of being underage.

Privacy & Data Use

Your use of the Service is also governed by our Privacy Policy (incorporated by reference).

You acknowledge and agree that:

• We may collect personal data, including, but not limited to:
  • Location data (precise or approximate)
  • Profile information
  • Usage activity and interactions
• Location data may be used to enable matching and proximity-based features.
• We may share limited data with third parties (including club partners) to facilitate the Service.
• We do not guarantee the anonymity of user interactions.

Account Responsibilities

You agree to:

• Provide accurate and current information
• Maintain the confidentiality of your login credentials
• Immediately notify us of unauthorized access

You are solely responsible for all activity under your account.

Location-Based Services

The Service includes features that rely on geographic location.

By using the Service, you:

• Consent to the collection and use of your location data
• Acknowledge that location-based features may expose your general proximity to other users
• Accept all risks associated with interacting with individuals identified through location-based matching

Matches, Messaging & Real-World Interactions

Bunker Bros facilitates introductions and communication between users but does not control or guarantee user behavior.

You acknowledge and agree that:

• We do not conduct background checks or verify user identities
• We do not guarantee the accuracy of user profiles
• We do not guarantee matches, responses, or participation in any activity
• All interactions, including in-person meetings, are undertaken at your own risk

You assume full responsibility for:

• Meeting other users
• Participating in golf or related activities
• Any outcomes resulting from user interactions

Assumption of Risk (Physical Activity)

The Service may facilitate participation in recreational and physical activities, including golf.

You acknowledge that:

• Such activities carry inherent risks, including injury, property damage, or loss
• Bunker Bros is not responsible for any injury, damage, or incident occurring during or after participation

You voluntarily assume all risks associated with:

• Playing golf or any activity associated with or resulting from platform
• Traveling to and from courses and all events affiliated with the Service
• Interacting with other users in any setting

User Conduct

You agree not to:

• Harass, threaten, intimidate, or harm others
• Impersonate any individual or entity
• Use automated tools (bots, scrapers, etc.)
• Upload malicious code or interfere with the Service
• Use the Service for unlawful or fraudulent purposes

We reserve the right to:

• Investigate suspected violations and activity
• Remove content and profiles
• Suspend or terminate accounts at our sole discretion

We are not obligated to monitor user activity.

User Content & License

By posting content, you grant Bunker Bros a:

• Worldwide
• Non-exclusive
• Royalty-free
• Sublicensable license

to use, reproduce, modify, display, and distribute such content for purposes of operating, improving, and promoting the Service.

Content Moderation & Reporting

We may, but are not obligated to:

• Monitor content or communications
• Remove content that violates these Terms

Users may report inappropriate content or behavior via support@bunkerbros.golf.

We reserve the right to take any action we deem appropriate in response to reported violations.

Payments, Subscriptions & Transactions

Certain features may require payment.

You agree that:

• All pricing will be disclosed at the point of purchase
• Subscriptions may be subject to auto-renew without additional notice unless canceled
• Payments are processed by third-party providers (e.g., app stores, payment processors)
• Refunds are subject to applicable platform policies

Bunker Bros is not responsible for:

• Payment disputes between users
• Failed transactions
• Chargebacks or fraud

We reserve the right to modify pricing at any time without notice.

Third-Party Services

The Service may rely on or integrate with third-party services (e.g., payment processors, location services, communication tools).

We are not responsible for:

• The availability or performance of third-party services
• Any damages arising from their use

Your use of such services may be subject to their respective terms.

Club Partners

Certain features may involve golf courses, club partners, or service affiliates

You acknowledge that:

• Clubs, courses, or affiliates may enforce their own rules and policies
• We may share limited data with clubs, courses, or affiliates for verification or operational purposes
• We are not responsible for club policies, conditions, or disputes

No Guarantee of Service

We do not guarantee that:

• You will receive matches
• Users will respond or show up
• The Service will be uninterrupted or error-free

Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.”

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BUNKER BROS DISCLAIMS ALL WARRANTIES, INCLUDING:

• MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

BUNKER BROS SHALL NOT BE LIABLE FOR:

• INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• PERSONAL INJURY, PROPERTY DAMAGE, OR LOSS ARISING FROM USER INTERACTIONS

Indemnification

You agree to indemnify and hold harmless Bunker Bros Entertainment LLC from any claims, damages, or expenses arising from:

• Your use of the Service
• Your interactions with other users
• Your violation of these Terms

Termination

We may suspend or terminate your account at any time for:

• Violations of these Terms
• Risk to users or the platform
• Any reason at our sole discretion

Force Majeure

We are not liable for failure or delay in performance due to events beyond our control, including:

• Natural disasters
• Network failures
• Third-party service outages
• Government actions

Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Florida.

All disputes shall be resolved through:

• Binding arbitration
• Conducted in or near Lake Mary, Florida

You waive:

• The right to a jury trial
• The right to participate in class actions

Changes to Terms

We may update these Terms at any time.

Continued use of the Service after updates constitutes acceptance.
